Notice: Draft Policy for Legal Review

This document outlines Jhanak’s clinical data handling principles for operational planning, developmental confidentiality, and design clarity. Formal legal ratification by statutory health law counsel is required prior to final production deployment.
01

Introduction & Clinical Ethos

At JHANAK – The Child Development Center (Greater Kailash I, New Delhi), we understand that navigating developmental differences, neurodiversity, speech milestones, and sensory processing needs requires the highest measure of trust, gentleness, and clinical discretion.
When families invite us to participate in their child’s developmental journey, they entrust us with intimate observations of home life, school reports, pediatric neuro-developmental assessments, and video-recorded therapy interactions. We hold this trust sacred.
This Privacy Policy details our systematic standards for handling, storing, securing, and sharing clinical and non-clinical data. Designed in alignment with the Digital Personal Data Protection Act (DPDP Act) of India, standard pediatric bioethics guidelines, and international neurodiversity-affirming care protocols, our philosophy centers on family empowerment and unequivocal confidentiality.

Purpose of Information Use

Data collected at Jhanak is used purely to optimize each child’s therapeutic, emotional, and social development. We operate under a principle of absolute purpose limitation:

Multidisciplinary Diagnostic Synthesis

Cross-evaluating clinical observations across Speech Pathology, Sensory Processing, and Psychology to chart comprehensive Individualized Support Plans (ISPs).

School & IEP Coordination

Assisting special educators and mainstream academic faculties to provide sensory-friendly accommodations, shadow-teacher alignment, and exam provisions under CBSE/IB boards.

Parent Empowerment & Home Programming

Sharing relevant family guidance and agreed information about home routines, with appropriate consent.

Administrative Continuity

Scheduling therapy blocks, issuing receipts for insurance or medical reimbursements, and dispatching milestone progress re-evaluations.
04

Child & Parent Sensitive Data Protections

We recognize that neurodivergent diagnoses (Autism Spectrum Conditions, ADHD, Dyspraxia, Sensory Processing Differences, Cerebral Palsy) and pediatric clinical data represent highly sensitive personal information.

Our Core Non-Negotiables:

check_circle Zero Commercial Data Monetization: We do not sell, rent, license, or trade family contact lists, child profiles, or assessment answers to pharmaceutical distributors, ed-tech brands, or data brokers.
check_circle Neurodiversity Affirming Storage: Clinical observations are codified with respect, avoiding pathologizing labels, and focusing on functional strengths and authentic developmental support.
check_circle Clinical Need-to-Know Access: Only therapists directly assigned to the child’s care team (e.g., their primary Occupational Therapist and Speech Pathologist) possess clearance to review session logs.
05

Storage, Data Security & Retention

Before sharing personal information, confirm how the centre receives, stores and uses it. This draft policy requires verification against the systems actually used.

cloud_done Digital Archiving
• AES-256 bit encrypted storage for digital intake questionnaires and therapy reports.
• Multi-factor authentication (MFA) required on all clinical management devices.
• Periodic off-site automated backups on localized, Indian-domiciled server architectures.
door_sliding Physical Centre Protocols (GK-1)
• Hard-copy clinical intake forms held in biometric-restricted records archives.
• Continuous CCTV coverage in administrative corridors (strict zero-camera rule in individual sensory and speech therapy suites).

history_toggle_off Statutory Retention Window: Pediatric clinical records are preserved in concordance with Indian Medical Council regulations until the child attains 21 years of age, after which non-statutory records undergo permanent cryptographic erasure or confidential physical shredding.
06

Information Sharing & School Collaboration

Pediatric development thrives when teachers, schools, and therapists communicate seamlessly. However, Jhanak maintains a strict Consent-First Collaboration Rule:

Signed Caregiver Authorization Required

We will never release assessment scores, sensory diet details, diagnostic letters, or IEP guidance to schools (CBSE, ICSE, Cambridge, or International Baccalaureate institutions in Delhi NCR) without an explicit, signed authorization form executed by the parent or legal guardian.
When consulting with external pediatric neurologists, geneticists, or ENTs, records are shared via secure, point-to-point encrypted transmissions, and caregivers are copied on all multidisciplinary dispatches.
07
